Find Divorce LawyerQ.I have been separated 1year; been through discovery; am waiting for trial date. However, I am having some scary thoughts about my lawyer. Very little preparation; very accomodating. Either she believes I'm toast or she doesn't care that I become that. Even my wife says she thinks she's just along for the ride. There was a book mentioned here, " How to Find the Right Divorce Lawyer". I have attempted to obtain it; but it seems to be a pretty hot commodity right now. Can anyone offer some suggestions from their experience about what I can do to settle my concerns. I'm running out of time. . .perhaps it is too late to seek another lawyer. . .or is it ever too late? I suppose after the judge has handed down his decision it's a bit too late for anything other than wailing and gnashing of teeth. A.You can always get a second opinion of your case from another divorce lawyer. Just choose one who isn't the type to tell you what you want to hear so he or she can acquire your case. First though, make a list of your concerns and meet with your lawyer, face-to-face and ask her all your questions. If you don't like the answers, get your second opinion. If you then realize your lawyer has acted unreasonably or irresponsibly in handling your case, take some positive action. You didn't mention if a trial date has been set. If you are very close to trial, (like within a week or two), and aren't able to work things out with your lawyer, you are in a tough situation. It will cost you more money to have a new lawyer get familiarized with your case. Also, if your new lawyer is prescheduled in another trial on your trial date or can't be ready by your trial date, your case may be continued by the court to a later date. Depends upon the facts and jurisdiction. Instead of spending the money on lawyers for trial preparation, a trial and all that goes with it, is there any way that you and your wife can settle your differences? It would be a lot less expensive for you two to work out as much as you can and then submit it to the lawyers to be formalized. If there are some things you can't agree on, ask your lawyer if those issues could be dealt with through some kind of a pretrial conference with the judge or a brief trial.
