Find A Probate Lawyer
Q.how do I go about finding a great aggressive effective lawyer for my situation? my relative had alzheimers, I am his only of kin and his poa who was supposed to just help with paying bills seems to be handling EVERYTHING beyond what he should----the relative now has died and I am realizing that the poa has probably already transferred property or made things favor him. I need a great lawyer to help me because I am several states away and I need to act fast. I am kind of fearful of these online legal find services----do they work well?? Any advice???
A.Some of the best probate lawyers in the United States are members of the American College of Trust and Estate Counsel (ACTEC). There is an on-line directory of members at www.actec.org/public/roster/search.asp if you would like to try to locate an ACTEC fellow in the state or county in which the relative lived (which is where the litigation would take place). Not all ACTEC fellows litigate, but many do, or might be able to help you find another experienced lawyer in the same locale. As far as I am aware, POA paperwork becomes null and void upon death. If this other person has been continuing to use their position as "POA," this could be fraud. You would need to find out what they have done (ie: moved funds from one account to another, etc) and provide the appropriate parties with a copy of the death certificate to show that it was done illegally. You should also get down to that State and go to a court and have yourself set up as the Executor of the Estate. That will allow you to direct what goes where, and you will not need to be in that State to do so.
