Find A Lawyer MarylandQ.I am searching for a lawyer in Maryland that has balls.This is for a wrongful death / malpractice lawsuit.Most of the lawyers I have spoken don't want to take the case do to the fact it is not a easy couple of phone calls and the case is complete. my wife and I were don't a great injustice do to stupidly and lack of competence. We have the medical records Any help??? or suggestion??? A.Generally, if you are unable to find a lawyer to represent you, it means one of two things: 1. You have no or a weak case. Either the facts are bad, the law is bad or you won't be able to collect if you win. Don't forget, *you* are required to prove negligence and the damages that resulted from the negligence. The doctor's lawyers can sit back and try to poke holes in your case, using the best medical experts money can buy. 2. You may have a case, but the likely recovery won't be significant enough to justify the time or cost necessary to win the case. Most experienced attorneys don't care that a case isn't "a easy couple of phone calls and the case is complete." We don't get very many cases like that in any event, and those that we do get like that are usually small cases. Medical malpractice cases, especially in Maryland, are *very* time-consuming, *very* expensive and don't settle (if at all) until the eve of trial...which is normally a couple of years after the case has been filed. You must have a written opinion from an expert physician stating that malpractice has occurred *before* you can file suit (with a few exceptions). Unless both the doctor and you agree, the case is first tried before a Health Claims Arbitration (HCA) panel consisting of a lawyer, a health care provider and a layperson. Either side then has the right to appeal the decision to the Circuit Court, where it is re-tried before a jury. Either side then has the right to appeal the decision to the Court of Special Appeals. Either side then has the right to ask the Court of Appeals (Maryland's highest Court) to hear the case. This process can take *years*, take thousands of hours of attorney time, and require the expenditure of tens of thousands of dollars in costs ($50,000 is not atypical for a reasonably serious case).
