Find A Lawyer In New Jersey
Q.Can a lawyer answer this one for me? (New Jersey) The relative of a friend got found guilty on 11 charges in federal court. I'm not sure of all of them but they include: wire fraud, mail fraud, money laundering, conspiracy to defraud ??, etc. I have two questions: 1. Do you know where I can find any list of mandatory minimum sentencing guidelines for New Jersey? 2. Does the judge have the option of making the sentences for each charge run concurrent or consecutive? And what would make him choose one or the other if he had that option?
A.Just a repeat of what has already been mentioned, sentencing in federal court is determined by the Federal Sentencing Guidelines. They are very difficult to interpret, so good luck. Secondly, I'm not sure what the guy above me is talking about. Sentences can be run together (concurrently) or separately (consecutively). For instance, if you get sentenced on five charges, each carrying a four year sentence, if the charges run concurrently, you only have to serve four years. If the charges run consecutively, you will have to serve 20 years. As a general rule, charges that are closely associated in time and event with one another will run concurrently and crimes that happened at different places and times will run consecutively. If it was federal court the judge will follow the federal sentencing guidelines...you can look them up online. And judges do have discretion in imposing sentencing...but it sounds like your friend is going to be in the can for a long, long time.
