Q.Can a divorce be obtained in Kansas without a lawyer ? I have a friend whos wife beat him up in front of witness.The police have record of it.His wife left with another man and has not called him back fo 25 days now.She also left him with the three small children to take care of by himself.They have no money for an Attorney and he is affraid she will come back and try to cause problems.He wants the children and a divorce.Any advice ???
A.Anyone can file for divorce (or just about anything else), without an attorney. It's called "pro se" - representing yourself. Many courts have a "pro se help desk" of sorts, that will provide your friend free advice & usually have a standardized form to just fill in the blanks. If there is a local law school, the law library will also have all the information needed to get the ball rolling. Your friend can contact Kansas Legal Services, which can screen him to determine if he would qualify for a free or reduced fee attorney. There is no official policy requiring Pro Bono representation in Kansas, and you didn't indicate what county in Kansas your friend is in. However, the law libraries at many Kansas courthouses will have forms which can be used. He would really need to get an attorney to do this for him, though, since with children involved, there are a lot of complexities. He should contact his local or state bar association for more information and possible referrals.
