Q.I live in Houston texas and i have a protective order from my wife and need advice what to do. i already have a lawyer and she is lying about the situation I am devastated because i LOVE my 3 sons and i can not see them and can not call either the children she went to the movies with me and the 3 kids 5 days after she file for protective order. and she is lying that i told her i am going to shoot her and attempt to hit her. I will never do that because i know in texas HOUSTon you go automatically to jail. need help i still love my wife and i want to go back home w/ her and the 3 kids CAN SHE DROPPED IT or what can happen. I hope she will feel mercy and think about how much i love her and the 3 sons we have.
A.The best way to handle this is to notify your attorney and to start documenting everything, conversations, threats, invites; dates and times. Let your attorney know you are familiar with the law of being sent to jail for violence etc....you can't go to jail if there's no evidence. There has to be witnesses for them to take you in I believe. She sounds like's she lost her mind and feels like she can do and say what she wants. If you keep yourself sqeaky clean, and I'm sure you do anyway, there's probably not that much that she can do to you. If I were you, I'd want nothing to do with her. If she creates lies to get in you in trouble and has a restraining order on you, she has issues. Perhaps you need to seek not only a lawyers help but a therapists evaluation (they can be very good at convincing judges as to whether you did this thing your charged of or are capable of harming your wife or children).
