Q.Any Chicago Lawyers out there? i need some advice from you. With the City of Chicago starting the new 'prohibition' on smoking, it's causing small privately owned businesses [bars, small restaurants] that would allow smoking [their clientele is mostly smokers] to go out of business....some that have had them for 30 years!! I'm a non-smoker and feel it is not right to have this prohibition on smoking. If I don't want to go in a bar/restaurant with smokers...I don't go. I have many friends who are smokers and are being treated like criminals for doing something that is legal?? Right now they have to stand 15' from any building to smoke. Taxes are so high on cigarettes that marijuana is cheaper. They are being dicriminated against because of their addiction. Food addicts don't have to stand 15' outside a building to eat. Sex addicts don't have to stand 15' outside to have sex. Alcoholics don't have to stand 15' outside to drink? You get my drift. Can a discrimnation lawsuit be filed? If so, how & through whom?
A.On the surface, you are correct that people who have addictions to sex, food, alcohol and so many other vices aren’t kept away the way smokers are. But the difference is, when you smoke, you affect other people who may be around you. Second hand smoke is a serious health concern. The US Environmental Protection Agency has classified secondhand smoke as a Group A carcinogen, which means that it is a significant causal factor to cancer in humans. Smoking is being restricted because everyone is vulnerable to secondhand smoke exposure in public places, such as restaurants, shopping centers, public transportation, schools and daycare centers. Although some businesses are reluctant to ban smoking, there is no credible evidence that going smoke-free is bad for business. Public places where children go are a special area of concern. If a restaurant existed that was for smokers ONLY, then that would be great. They all the smokers could dine and socialize and snort each other’s smoke. But when there are non smokers present, it’s unfair to subject them to the health hazard of breathing in the smoke.
