Q.I need family law legal help really bad. awful situation with my ex husb He stole kid 2 MO. No $ No lawyer my marriage was not working. My husband left Las Vegas where our family had resided for 3 years and went to his home town in Missouri. I made the mistake of my life allowing our 8yr old little girl to go with him to see her grandparents for two weeks then husband was suppose to bring her back to me. The husband has proved awful character and i've found him to be the most dishonest person I have ever met, so before they left to Missouri I wrote a very specific binding contract stateing we both have agreed for April to go on the trip and He has to promise to have her back in las Vegas with me by a certain date. This was on July 12,2004. He rarely lets me talk to her, If he wants something he Uses our girl for blackmail. Just this month After lying to a lawyer and also family courts about having no idea where i was, he managed to divorce me and was given sole physical cousody. I lost by default. Bottom line, I need legal rep. Any help???
A.Do you have proof that your husband was residing in Las Vegas six months prior to him moving to Missouri and filing for divorce? If you do, find out what county he is in and contact the clerk of courts in that county immediately. They will direct you through the proper legal channels. In the meantime, take the legal binding contract you and your ex had prior to him leaving to the police station and file kidnapping charges immediately. If you have a known address, give it to the police, they will transfer the warrant down to Missouri and your ex will be picked up and your daughter returned. Then take all your paperwork to your county courthouse and file for soul custody with supervised visitation. I've seen this happen a few times in my day and as it stands, with the contract you and him both signed, he's breached it, purjured himself to the courts and is in some pretty big trouble. Now get off this computer and go and get your daughter back...the police department is open 24/7.
