Q.What does a disability lawyer do?My appeal is upcoming and my lawyer hasnt even discussed the exibits list? I know they go to the appeal with you but what will they do if they haven't even discussed witnesses, or documentation you may have.Maybe my attorney is just not doing any investagation into my medical charts, and he doesn't have good outcome with his clients. I ask his office legal assistent just what the protocol was, and all that but the answer I got was"we would wait for the appeals office to set up an appointment and the lawyer would contact me, and talk to me before we appear in court that day. ?? I'm thinking even a genius needs some time to prepare. Anybody been through the final appeal,attorney/good or bad,process recently?
A.At a minimum, you should write the attorney about this matter as soon as possible. If there are particular documents or other information that you think he/she should include, you should describe that in detail and explain that you think the information will be important to your appeal. It may be, however, that the record on appeal is limited to whatever documents and witnesses were presented to the agency/judge/hearing officer that made the decision that is on appeal. In other words, if the decision you are appealing was based on Documents X, Y, and Z and the testimony of Witnesses A and B, you may not be allowed to present any additional documents or witnesses on appeal.
