Q.I am going though hell and my wife too. DIMIA in Manila refused her a visa 309 to come to Aus and live with me, and NZIS in Manila also refused a Tourist Visa to visit NZ over Xmas with my family ( I live in Aus but from NZ) They both said they don't believe we are genuine. I say that's bullshit and they got it totally wrong. in other words they are calling us liars, does the marriage mean nothing, my wife's family must be devastated their daughter and them have done the right things to see her off and married the proper way and now its back fired on us all. Iwe are the most genuine couple and they can't see it. The system stinks and has let us down. We did everything they asked for and still we the wife did not meet their requirements yet I know of others in the same boat who just breeze though, something is wrong and unjust towards us. Any advice for me???
A.I suggest you hire a good immigration lawyer. Manila do have an evil reputation for doing this. You do need to see a MARA registered migrattion agent who has had experience in this area. When the decision went against you, you has her sponsor has a right of appeal to the Migration Review Tribunal (MRT). You would have had a time limit in which to appeal. If you are still within that time limit then I would see an agent who will lodge an appeal for you, and then help you gather the evidence for the appeal, including getting access to the contents of your wife's immigration file from DIMIA in Manila through the Freedom of Information Act. Once you know the grounds that are being used by DIMIA to refuse to grant your visa you and your agent can prepare a case for the MRT. Note that the MRT often overturn decisions made by DIMIA. The agent we work through in Perth has won 36 out of 37 cases to November last year. If the time limit has already run out to Appeal, then you may have to lodge another application first.
