Q.Does anyone know what OUR rights as parents are when someone annoynomously calls Family Serives and accuses you of child abuse? We are interested since our son broke his leg. Someone said that our 'story' didn't line up with the injury allthough the doctor said that this type of break is common with kids... go figure. Anyway, once called on, they investigate and as far as I know there is 'no' way to clear our names.... any ideas or suggestions would be greatly appreciated. We are cooperating with these people however, though I know they are just doing their job, the ways the laws are written we have no recourse that I know of...
A.I STRONGLY suggest that you call HSLDA (Home schooling legal defense association). If you were members before the report, then they will act as your counsel during this investigation; however, even if you are NOT members, they are in a much better position to tell you exactly what your rights are. In short, social services will usually tell you that you have no rights; however, the constitional rights all Americans enjoy is something for you to insist upon. This would include things like them needing a warrant to enter your home. Call HSLDA. If you are not a member they can recommend a lawer who can help you. If you are a member and they think it likely the objection of Family Protective Services or the anonymous tipster is to home school they will represent you and tell you what to do. (DON'T rely on my memory of last spring, PLEASE!)
