Q.I need an advice from immigration attorney I came to USA on international student visa - F1 Married a US citizen 2 month ago and want to change my family name to my husband's. We didn't apply for the green card yet, but are going to. What is the procedure to change my family name? What should be done first? -Should I file the green card application with the husband's family name? But then I will have discrepancy between the passport and the green card. -If I go to my country to change the family name, how will I enter back to USA, as the student visa or the green card I will have will be on my old family name. -How to end up this dead-lock? Where should I change the name first?
A.I'm not an immigration attorney, but let me ask you this. Do you have a Social Security number? That would the first place you'd need to change your name. Otherwise, you can put you married name on your AOS paperwork. Your EAD and green card will come in your married name. When you have your EAD, you can apply for a Social Security card in your married name. Whenever it's convenient for you, you can change your passport to your married name. If you travel back home using the passport in your maiden name, make sure you purchase tickets in your maiden name, and carry a copy of your marriage certificate to show the difference in names between passport and green card.
