Employment Law

Q.I wonder something related to Employment law. My husband has recently started work and has asked about his contract, his colleges have told him they dont have contracts 1 bloke has worked for the company for 15 years and said he has never recieved a contract of employment is there a law regarding employment contracts ?

A.1.) All employees have 'contracts', whether written, verbal, custom.....whatever. Your husband works in a certain role, for a certain number of hours and gets paid a certain amount - that's a contract. 2.) Most people confuse 'contract' by what is actually a written statement of particulars. This is a document outlining the essentials of the 'contract' i.e. job title/role, hours/days to be worked, pay, notice to be given, holidays etc. All employers are required by law to issue employees with a statement of particulars within the first 8 weeks of employment. Refusal to issue one can be challenged at an employment tribunal, regardless of how long an employee has been employed beyond 8 weeks. A tribunal can order an employer to provide a written statement as well as awarding compensation. Your husband would be advised to seek assistance from his union and if not a member to join one. Better still would be for all employees to be in a union and for this to be tackled on behalf of everyone.
