DWI Louisiana Laws.?Q.In "DWI law is already based on faulty 'science'... " article: "People get RailRoaded for DWI from the aspects that there is an army of American drivers, out there, who will not be impaired , nor be intoxicated, due to their acquired tolerance, at [or] above the legal limit... since the DWI law has been already made overly simplistic in order to get the maximum number of DWI convictions. When the state law is lowered to 0.08% BAC from 0.10% BAC , The overly simplistic DWI law is not scientificaly nor medically based since it is based on 'faulty science' mainly that: "WE are all the SAME", which is Orwellian or Communistically in design or in erroneous fundamental concept.. " What's your opinion??? A.Yes, alcoholics do gain a tolerance for EtOH. However, if we assume that the majority of drivers are not alcoholics, then the tolerance issue becomes less important, nicht wahr? No,it's simplistic simply because other means of judging impairment are more subjective and easier to challenge in a court of law. Let's face it, there are folks who are worse drivers at 0.0% BAC than some are at 0.05% BAC. Tired drivers, I suspect, are responsible for many, many traffic accidents and fatalities. So is impairment due to drug use, be it legal, illegal, or OTC drugs. The "correct" way to determine impairment would be the adminstration of a performance test. Oddly enough, that's what the "walk-the-line", "stand-on-one-foot", "touch your nose" tests basically *are*. The blood/breath test simply either provides evidence against you or on your behalf, depending on the law and the results of the test. If you don't fail the basic performance tests, then you won't have to move on to the other tests.
