Durable Power Of Attorney Health
Q.I'm a student in a law school. I'm in need of some information to complete my assignment Might someone give me a good example of using a non-durable Power of Attorney? Seems the Durable POA makes more sense. What's your opinion? Anyone help me???
A.Ordinary non-durable power of attorney is commonplace. For example, you give an escrow agent a power of attorney to record the deed to property you buy or sell, so you don't have to do the legwork yourself. An ordinary power of attorney becomes invalid if you become incapacitated, but it's usually given only to do something specific at the time it's given. Durable power of attorney is used when you wish to have someone act on your behalf in the event that you become incapacitated. The common example is a durable power of attorney for health care. This allows your representative to give informed consent and make other decisions regarding your care when you can't make them. While I am out of the country, I want you to deal with anything that comes up. While my son is attending college in your city, I want you to sign whatever he needs regarding aid applications and medical consents. While you have my daughter with you on a camping trip, I want you to be able to authorize medical care. Durable would work in all of those cases, of course. But if I don't want the powers to continue after I become incompetant, because I want my conservator or guardian to take over, or for some other reason, it's ok to use a non-durable.
