Durable Power Of Attorney For Health Care

Q.Any suggestions for me??? My question is that when a living trust may be better than a simple will for someone with perhaps $300k in home, stock and CD assets (no family business to keep running)? What is your opinion???

A.In addition to Living Trust, may I respectfully suggest you also execute a Durable Power of Attorney for Health Care. This is something like a Living Will, but stronger. It is an instrument that sets forth your wishes in the event of incapacity. Do you want to remain hooked up to tubes, in a vegetative state, or do you authorize [person] named as holding your Durable Power of Attorney for Health Care to order that the plug be pulled. Unless your wishes are spelled out clearly, *n writing* with a copy to your Executor, your Doctor, and the person holding your Power of Attorney, a horrible situation could result. Not to dwell on the macabre, but there are constantly cases reported where the person is no longer able to express his/her wishes. One part of the family wants the plug pulled; the other part doesn't; the hospital/doctor doesn't dare act for fear of being sued. It becomes grisly. I know people don't like to think about things like this, but the time to act is *before* you become incapacitated. You don't need an attorney to execute this form; just know what you want.
