Q.Driving, having done nothing wrong, I was pulled over by a police officer. Asked police over reason for stop. Says routine license plate check. I'm speechless. Police demands ID. I give. Go's back and run's check on ID. Comes back asks for insurance. Don't have. No insurance ticket time. The question is: Was this a legal stop? As I thought I understood it, law enforcement can't run license plates unless they have probable cause, which they did not in this case. His sole reason for stopping me was based on a plate check, if that. I'm going to contest this and would appreciate any advice on prior cases or statutes that I can reference. In case it matters, I live in Minnesota.
A.Sounds specious, but rules are State specific. So do contact a MN attorney who specializes in Probable Cause Traffic cases, perhaps a good DUI lawyer. Then contact a lawyer and have him challenge the errant cops to a SmackDown! As you have told the story, I see no PC, BUT in VA at least, PC can be as much as a sticker on yur back window or something hanging from you rear view mirrow. I think your best bet is to go to court, show the judge that you indeed had insurance on the day and at the time in question. In Massachusetts, I think the police would have to make some effort to determine whether an owner with a suspended license was actually driving before stopping the car. The Massachusetts Supreme Judicial Court is often out of the judicial mainstream so the rule may be different in Minnesota.
