Q.I was recently pulled over for my first DUI offense. My blood alcohol level limit was 0.11 and I cooperated with the officers completely. But, I'm still in a lot of trouble (possible license suspension for a month etc., the usual) and believe me, it's a very intimidating and dreadful experience. Definitely never want to go through this again - I have learnt my lesson. Anyone help me and send me your opinions (referrals or complaints) on DUI/DWI attorneys in the Bay Area/Northern Calfornia. The attorneys I've talked to charge anywhere from $2000 to $8500 (and that's without going to trial).

A lawyer's income does not depend on his/her hourly rate. It depends on what s/he collects. In most jurisdictions, there are legal restrictions on the ways in which a lawyer may secure his/her fees. It is axiomatic that what you get up front is IT. The collection rate drops to insignificance after that. But a lawyer cannot know at the outset whether s/he is going to have to spend 3 hours or 30 hours on your case. Furthermore, s/he will not know until it is too late to withdraw from you case without your consent. The practical solution is a SWAG (Scientific Wild-Ass Guess) to determine an advance retainer somewhere between what it will probably cost and what it might cost, having in mind the lawyer's current ability to risk economic loss and the client's personality type -- which is usually "alcoholic."
