Drunk Driving AttorneysQ.I had to appear before a village magistrate in New York state today for a traffic violation. I've grown a bit around the waist so my suit did not fit, and I opted for dress pants and a sport coat that did, along with a tie. I thought that was what I was supposed to do. I was the only male defendant in a jacket. Some men wore shorts, sandals, flip flops, sunglasses...one young man had on a baseball cap. Very few had on collared shirts. I was overdressed. This was a magistrate court so the offenses were rather minor misdemeanors, although there were failure to register as a sex offender, possession, drunk driving arraignments - not just speeding tickets like mine. Since most of the defendants with more serious offenses had representation, I was wondering, what level of court or charges do attorneys counsel their clients to dress up a little? Do defendese attorneys worry when their clients show up looking ready to go to the beach? A.i'm not actually an attorney. i've counseled some friends through court proceedings as an undergrad over the past 4 years--lots of speeding tickets and open container kind of stuff. if you're in any kind of trial, the defendant's almost always in a suit. for more minor offenses, you can cut down to a collared shirt and pants. the judge in our area (i'm from ny too. fredoina, chautauqua county) insisted that people say "yes" or "no". you would be amazed at how many people still said "yeah", "yup", "nah" or "nope." so it's still advisable to wear a jacket. it shows that you take being in court seriously. only when you're a repeat offender/constantly on the roll call do you really want to give that up.
