Q.Currently I am going through a divorce( I am the petitioner, she admits adultery)) and 'buying out' my wife's share of the property we own .The property was in her sole name. She wanted a quick divorce and we had a disagreement about costs in the presence of my solicitor .The solicitor advised us to go away and discuss it and we had a second appointment. To sum up I have had a divorce petition sent/raised with the courts that say we split the costs of the divorce. My wife, in the presence of my solicitor has stated she would pay all the divorce costs.The equity of the property is 22,000.She wants 10,000 and all costs of the sale/purchase comes out of the equity. My main problems are 1 If I tell my solicitor he is at fault and refuse to pay the extra costs and instruct him to refile the divorce and face the costs. Could he refuse and say he longers wishes to represent me or just say he was not at fault ? Where would I stand ?. 2 If the petition stays showing half costs would my wife's verbal agreement mean nothing and by law I would have to pay half ? Would a signed statement suffice that contradicts the petition ? 3 if changed to pay full costs would the courts/judge look at the fact my wife is not represented and issue a 50/50 split anyway. Would the fact she is getting less than half of the equity, although she does earn twice as much as me and has shares etc influcence the courts decision ?. It's her choice not to have a solictor as she wants to do it as quickly and cheaply as possible.
