Q.I know of someone who remarried a woman with severe mental problems. She was under treatment with a psychiatrist. Anyway, she was arrested and tried and she walked (with no penalty) because she was not responsible for her actions. Btw if you don't think the legal system is sexist try playing this one through with the sexes transposed. Now, obviously this is a bit extreme and a rare case, but you'd be surprised at the number of men who've confided in me about a post-divorce relationship with a real nutter, after which they suddenly got terribly wise re female mental illness. It gets less than amusing when you need to forcibly remove the girlfriend to the nearest loony bin. Or they attack you in a dangerous way while they are off the planet. Btw these people may present well enough when they are on their meds and not under any particular stress. However, their hold on reality is precarious at best. Just keep it in mind when out and about.
A.The issue of how -- or if -- a divorce can proceed when one of the parties is judged mentally ill has sent lawyers on both sides into complicated and obscure legal territory. A vivid example arose last week when the judge hearing the Lemaks' divorce case invoked a recent Illinois Appellate Court ruling that he contends could put the divorce in limbo indefinitely. The latest developments are another twist in what has already proved to be one of the most dramatic and complex murder cases in recent memory. In an opinion published earlier this year, an Appellate Court panel in Chicago ruled, essentially, that a disabled or incompetent divorce petitioner may not proceed in a divorce case with a guardian acting in her place.
