Divorce Attorney DallasQ.I'm going to be filing for divorce in the next couple weeks. As of now it looks to be an uncontested divorce - we've discussed all the circumstances that we can think of and agree on all - but I'm still inclined to have an attorney involved in this rather than going with a "do it yourself" kit. We will probably go with one attorney (I'll pay him/her, so it will be my attorney) to coordinate the documentation, do filings, etc. Given those circumstances, what questions should I ask prospective attornies to determine which I'll select? A.Here's what I'd recommend: 1. Get a FLAT-FEE quote for the divorce, or a "fee cap" which prevents the bill from going over a certain amount, or pay a retainer with the understanding that the lawyer is not to withdraw from the case prior to its conclusion, and would have to bill you for any excess over the retainer amount. Be prepared to pay a lot of money up-front in both cases, but in return you get security. If you don't have a lot of money, you can still get both types of fee arrangements, but the more you have, the better. 2. Make sure you shop around, and take advantage of any free consultations. You can also use consultations to build on each other, answering 1-2 questions at each and piecing the puzzle together yourself, having it ready for when you do retain an attorney. 3. Get a retainer agreement which spells out how you expect to be represented. I won't even try to guess at what questions you should ask - its been too long since my divorce, and it was a different era "back then". But the firm of Boswell & Kober has offices in both Fort Worth & Dallas, and is a reputable practice. But IMO if the divorce is amicable and uncontested, what you want is someone ethical who won't stir up trouble to increase their fees - and B&K fit that bill just fine.
