Denver Personal Injury Attorney
Q.I recently was involved in a cycling accident which resulted in my being injured. I was passed by a truck while traveling down a residential street. The truck pulled over to the right side of the road to make a left turn, leaving me about two feet of shoulder to ride on. When I got up off the road I realized I had a broken hand. I requested the name and address of the teen but he refused, then fled the scene of the accident. I am in the process of locating the teen, and getting pretty close. My injuries require surgery to put pins and/or a plate in my hand to hold the bones together. I have no insurance to cover the costs. I am a roadie/trackie and mtb racer. Also, I am a Greenskeeper, so my career has been jeopardized as well. I was simply riding home from a race when this happened. Does anyone know of an attorney in the Denver area who might handle this case?
A.They should not have gone that far to the right under any conditions when they have just passed any vehicle. Also, even if you find the teenager, you probably won't be able to collect anything unless their home owners policy covers that under libility. And if they rent, they probably have no insurance coverage. This is just one of the reasons why I think states should require that companies writing auto policies offer equivelent insurance for bicycles, and that any cyclist using the street must be covered. Considering that they don't, do you have the option to sue the city or state? Another factor in the negligence of the state is that most don't provide or require any kind of training for anyone riding bikes, or training for drivers actions around bikes. An accident with a personnal injury would require a police report in most states. Considering that you were injured and everyone else left the scene could be a valid reason for not filing a report immediatly. And they *should* investigate the hit and run.
