Q.DENVER (AP) -- When NBA star Kobe Bryant goes on trial later this jurors will be allowed to submit questions for witnesses in the sexual assault case under what is believed to be the first rule of its kind. The possibility of juror questions in criminal cases is both exciting and scary to judges and attorneys. "I'm hopeful this will be beneficial, even though I'm nervous about this. The reality is, no one knows how this will work," said Scott Robinson, a Denver criminal defense attorney. Jurors have been allowed to ask questions in Colorado civil cases for the past five years, but attorneys say much more is at stake in criminal cases. The rule takes effect statewide July 1. What do you think about this move???
A.IF the judicial system was concerned about justice, and not just finding out which lieyer presented the best case, they would let the jurors individually question each witness until they were satisfied, and then call witnesses they wanted to ask or hear from again. The bigot on the bench will probably censor the questions to "protect" the "victim" under Colorado's "rape shield" sexist law. The article was amusing since it didn't mention that in most European countries, having jury trials, jurors have the same rights to ask questions as do the lawyers. The lawyers must send an offer of proof to the judge(s), for each witness, outlining the questions that they want asked. In general, the witness knows ahead of time, what they are. The judge(s) then do the bulk of the questioning. After that, the lawyers and jurors can ask follow up questions in a round robin fashion. Would adopting such procedures in the USA lead to mass lawyer suicides?
