Denver Criminal Attorney

Q.a friend of mine who also happens to be an international student, got an offer from General Electric after his graduation. And so he went out and made a downpayment on a car and stuff like that. Then he hears back from them and they said they made a mistake because they thought he was an US citizen or a permanent resident here. So they are retracting the offer they gave to him, and as compensation they are trying to work out something in their Singapore office (his home country) so that he can get a position there, but there are no gurantees. So, he's kind of screwed right now. He talked to the people in the career service department in our school and they told him that there really isn't much that can be done since an offer from a company is not exactly legal binding. So should the offer from the GE branch in Singapore not materialize, he's kind of screwed since he has a car he can no longer financed and he also lost quite a bit in job opportunities since he turned down two other offers he got. Is there anything that he can do?

A.Probably not. Contracts isn't exactly my specialty, but I can tell you that your career service office is right about an offer not equaling a contract unless your friend accepted before the retraction. Now, if he can show detrimental reliance on that offer (such as say...a down payment on a car), he may have something going. Did GE ask/know he wasn't a citizen at the time he received the offer? One long shot might be try the office of his U.S. Representative or Senator to see if anything can be done quickly about citizenship. Whole buncha folks get made citizens by private bills in Congress, or at least used to. Maybe if he's in New York he can talk to an influential candidate for U.S. Senate who can talk to her hubbie about this. I suppose another long shot might be if his state's laws on discrimination based on nationality do any good for those who do not have citizenship. That at least might get the company to conceed quickly and quietly without wrecking the rest of his career. Haven't looked in long enough to know if federal civil rights act stuff applies, either.
