Criminal Lawyer NyQ.I pay my taxes - everything I owe, and I pay on time. But I'm not declaring this 1099; I'm not paying this tax on someone else's gain. The problem is, I just don't know a good way to fight it. I'm a 55 year old computer type electronic engineer (BSEE 1965, NC State University). When I became a part of Xetron Corp's "competitive reality" in 1993, I had only 4 years and 4 months of service. So, the company (Xetron's a government spook operation, owned by Westinghouse at the time) kept their $26K+ of the pension/401K-matching money, and sent me out the door with a month's severance. My 1099R lists Xetron Corp as the PAYER, but they never paid any 401K distributions to anyone! They only received. (City bank of NY was the trustee, and would be the only company that could have any right to issue me a 1099R.) I have been around and around the loop on this with the IRS. Turns out that the taxpayer's advocate in DC works for the IRS, and has been as unresponsive as the IRS "National" people behind all this (Westley, Sloan, Hallsten & Richardson). The local IRS problem resolution person, Fay Baker, had told me to contact Ronald C. Hallsten (CP:E:EP:VCR) at National. That's who Xetron claims instructed them to have me apply for the 1099R. He refused to answer my first certified return-receipt letter last June, and has since then refused to answer all follow-up letters. Since I didn't request the 1099 from City Bank of NY, as Xetron insisted I should, they issued the 1099R to me themselves. Additionally, Xetron did benefit from the $23,875.47 (plus interest) they confiscated in 1994. I believe that they have no authority to be issuing any 1099Rs, and their claim that they distributed $4,457.06 to me is totally fraudulent. I quite seriously would like to file criminal charges against Xetron (now a subsidiary of Northrop Grumman Corp), their Director of Business Affairs (who generated the 1099R) and the Xetron president. I need advice on filing such charges, including how to actually do it. A.For what it's worth, I don't really think you have a case. I know it seems like a grave injustice from your point of view, but the Tax Code is not about justice. It never has been and never will be, in my opinion. Your employer followed the rules as given to them by Congress, and as interpreted by the IRS, and as enforced by the courts. Pension plan administration under the ERISA law is a complex area and anomalies abound in this complexity. Sometimes this works for us, and other times it works against us. Let it go.
