Q.My 14-year-old son and his friend were recently called into the police department for Prank Phone Calls to a girl. I can only talk for my son. He and I went to the police department. The investigating officer gave us the spiel that he hates being lied to and if my son lies to the officer the officer will charge me with the Prank Calls. See, the calls were traced to my phone number. Therefore, it's a fact that five of the calls came from my phone. The officer also had a recording of someone--it was my son's friend-- making the call and talking in obscene gestures. After the officer's spiel about lying, he left the room so my son and I could think and decide what we were going to do,i.e. my son admit that he did it or leave and take our chances on beating the charge. Can anyone lead me to a web site where I can obtain legal information pertaining to misdemeanors, i.e. Prank Phone Calls concerning juveniles, particularly 14-year-old boys in Junior High School? I can't afford my own lawyer. Yet I don't want to just go to court and throw my son on the mercy of the court. I don't trust our legal/justice system to just let them have my son

A.If you cannot afford a lawyer, the state must provide you one free of charge....... Public Defenders............ Perhaps a better lesson for your child would be.........make him pay the fine...and help him to understand that what he and his friends did was wrong....... as for the police officers, if your son was under arrest for a crime they should have read him his "miranda" warnings.......you have the right to remain silent....etc. and if they didn't read him is rights, your lawyer will have the statement surpressed.....they will not be able to use it against him in a court of law...... Don't worry to much. The cops say anything hey want. Its all irrelevant. The D.A. will not proceed with charges unless kiddo threatened her in a real bad way or something. Pranks are just that, pranks. Charge you with "prank calls", yeah, un huh. If all junior did was make an obscene call I doubt he will even be charged . Now if he was stalking, or you are raising a Trenchcoat Mafioso you might be in a different pot of stew. If he is charged, plead not guilty, go to trial with a P.D. and cost the system as much as the fine would be anyway.
