Commercial Real Estate AttorneysQ.I think some caution is a good idea when dealing with real estate attorneys. I guess it's a matter of professional pride or trying to earn a higher fee, but they just don't seem to be able to keep themselves from modifying a standard contract. They can also dicker over the dumbest possible stuff *and not tell you*, whether it's a right-of-way that you know about and are cool with or whatever. I've purchased land and used the seller's attorney at closing, although I think it's probably not a good idea in the general case. What do you think??? A.sure. There are bad attys out there, and the above is a pretty good characterization of a bad residential RE atty. On the matter of RE attorneys (the other matters I don't wish to comment on), the above is all possible, of course. There are some awful RE attys out there. Some caution is always recommended in choosing one, like one would exercise in choosing any professional for service, and there are ways to find *good* ones (such as contacting your local bar for recommendations). Your list of cautions, though, is reasonable, and I can see them happening with some attys here and there. I would hope that anyone would avoid such). Then again, I know a couple residential RE attys, and used one for my condo purchase, and didn't experience any of the above. My wife is an attorney, doing *commercial* real estate[1], and I am well aware of some of the characteristics of bad attys, but also of responsible ones (which are the majority). One reason to have one, among others, is precisely to propose and negotiate modifications on standard contracts. They are supposed to represent you the buyer/seller, and really shouldn't push anything without your consent. I still think that for a personal real estate transaction, having both an inspection and the services of a good residential real estate attorney is a very good idea.
