Colorado Real Estate Attorney
Q.Looking for general information about selling a home: What taxes and fees (local, state, and federal) must a homeowner pay when they sell their primary residence, with the intention of buying another home in a new location (out of state)? Any idea how much a real estate attorney costs to handle the legalities of selling a home? I'm wanting to sell myelf since Realtors are typically bottom feeders who collect a commision for for doing little to nothing other than putting a home in the MLS for you.
A.Colorado has no Sales Tax on Real Estate that is owned by CO State Residents. Out of State owners pay a small sales tax. There are capital gains taxes to consider, with certain allowable exemptions, so check with an accountant about your situation. but if you want a good recommendation on a real estate attorney, I had an excellent experience with John Sullivan when I sold my condo last year. The basic situation was that after a couple of strange incidents I had zero trust left in my bottom feeder (learned my lesson - will go FSBO from now on), and I felt the need to have an attorney present, just to make sure he knew he wasn't going to get away with anything else. One of the things I really liked about John was that he listened to my story, looked over the paperwork, and told me that in truth things looked to be put back in order, and I really didn't "need" to have him there at closing. I hired him to be present at closing anyways, because at that point I was pissed enough that I felt the need to make that sort of statement to my bottom feeder. But it was refreshing to encounter that sort of honesty after what I had just been put through. I believe his rates are somewhere around $150/hour, he might offer a package deal on an entire contract process but I'm not sure. If he doesn't, many other attorneys do, and they tend to range from $400-600. If you can't find him in the phone book I'll dig up his number for you. He's near Baseline & 30th in Boulder.
