Q.I have recently moved to California from Colorado. Are my Colorado will and Power of Attorney for finance valid in California? Any advice for me???
A.That depends entirely on your individual situation. The only person who can give you a definitive answer on this is a California probate and estate planning attorney who has reviewed them and whom you have told what it is you want them to accomplish. If they do not do in California the things you wanted them to in Colorado, you will need counsel to revise them. Or Ask a California attorney to look at the instruments and tell you. The will, if valid under Colorado law when you executed it, should be valid in California. Powers of attorney should follow the same rule, but as a practical matter, agents often have a difficult time getting the out-of-state power of attorney accepted by third parties, so you should probably execute a new power of attorney.
