Q.Should I get my own lawyer now, or should I wait for my auto insurance to tell me when. I rear ended someone on a rainy day about a year ago, the driver has not gone back to work yet. My coverage is 100,000
A.Were you yourself injured? Is there any reasonable way that the other party could have been at fault? If No to both -- and if you rear ended the other driver then probably you were completely at fault -- then I don't think you need a lawyer. Since you have liability coverage, and you have reported the accident to your insurance company, let them handle it. If you get sued, they have to defend to protect themselves from paying out $100K. (Most likely, of course, they'd settle with the plaintiff for something under that.) I might say get your own attorney if you were pretty sure the total liability would substantially exceed the amount of your insurance, but you didn't tell us that.
