Q.We will see how an unpredictable Texas jury rules on this one. I can't understand why UP even offered them any money. A fifteen year old steals two vehicles, goes joy riding, and when trying to "catch some air" under the SUV at a level crossing collides with a train. At what point did I lose sympathy? "A Baytown teen was charged Thursday with felony murder in the deaths of four companions who were killed in June when the stolen car he was driving slammed into a train idling at a railroad crossing." The family's lawyer previously said: "The stolen vehicle didn't contribute to the crash collision and the deaths. What contributed was the fact there was an unmarked, unlighted crossing with a train parked there for 34 minutes."

A.Some railroads have decided to take a hard line on level crossing accidents as a result. They were getting sued by lawyers who knew the railroads would make a settlement offer, even if the cases likely would have been settled in the railroad's favor. These railroads decided it was costing them more in the long run, and will now fight every case in court in an attempt to deter the number of lawsuits. Railroads have also found the use of video cameras on their locomotives have paid off in reducing the number of lawsuits. Many times a lawyer representing an injured client would insist that the crossing protection circuit hadn't been functioning properly, or that the engineer hadn't blown the horn. Eye witnesses couldn't remember, and often would agree that something hadn't worked. The videos ended that kind of speculation, and also showed how the driver reacted to the approaching train. You'd clearly see cars drive around gates, or stop then suddenly try to beat the train, and so on. Often all it took was for the railroad to show the lawyer the video for the lawyer to drop the lawsuit.
