Blank Power Of Attorney

Q.My father got into an accident, my sister and her lawyer back dated a deed transferrence from my father to my sister. my sister signed my father's name. Now he's passed away, the lawyer in question gave me some papers to sign via my sister which weren't filled out. If the house was specified in the deed, and the house was already transferred before death, does that make the deed null and void?

A.Its not very clear what you are asking. Was there more than one transfer? Did you sister have power of attorney? Did the power of attorney expressly say she could give property to herself? When was the deed recorded? Did you father have a will? If so, when was it probated? Do yourself a favor: Hire your own attorney to advise you in this matter. No one can properly advise you unless they have personaly reviewed the documents related to this transactio(s). And don't sign blank forms. The house was in his name, as a matter of fact he listed the house. He had a stroke. My sister, realizing that he was going to sell the house without her knowledge, asked her friend the lawyer to back date the transfer of the deed to a date BEFORE he went to the hospital. Now the house is in her name. I'm almost sure, she didn't have power of attorney for his fiduciary matters. Especially when at the hospital she outright admitted to forging his signature and how her friend could get in trouble if any one found out. Hell, no I wasn't going to sign anything blank, they must have thought I was stooopid or something. I will find a lawyer, I called one he wants $2,000 as a retainer. I just have to stall them until I find a lawyer.
