Best Personal Injury AttorneyQ.I am wondering whether it is worth hiring a personal injury lawyer? You always see these advertisements claiming no win no fee or that you win 100% of the compensation. I am wondering if there is any truth in that. I have a friend who was in accident and the solicitor wanted an upfront payment. How do these lawyes get paid? I am assuming its through the award of costs after trial. What if there was a settlement? Do they get paid? Any suggestions for any good resources? A.most personal injury attorneys take cases on a contingency fee basis. That is, unless the client wins his case, through trial or settlement, the attorney does not receive a fee. If the client is successful then the attorney receives a percentage of the proceeds. Some attorneys take the percentage from the gross amount received while others take the percentage from the gross amount minus expenses. Most attorneys, because of ethical rules, will state that the client is responsible for the expenses should the client not be successful in the case. Whether or not the attorney attempts to collect the expenses is up to the attorney. There are attorneys that take on contingency fee cases on a percentage basis but still require the client to pay an amount up front to cover expenses. It just depends on the attorney. Percentages run from 33 1/3 percent to 40 percente. Anything above that is high. I don't know what area of the country you are from but good information on personal injury cases can be found from websites and blogs. There are two exceptional ones in CA by Jonathan Stein and Norman Fernandez. Just google them and you should find their sites. So much for the old saying that "You only get what you pay for." I would shy away from any personal injury attorney who seeks up front costs however. I would consult your local State Bar also. They will be able to provide some direction regarding the most prominent consumer attorney (PI) group in the state who will be able to address your concerns under the guidelines in your region.
