Q.A very experienced attorney (one of the best in the country, in my mind) told me about the prospects of getting an EB1 (or AEA, as you call it). What will your salary be? When I named a number, he said "forget it. If you don't make at least $300k/year, you won't stand a chance". I think he wanted to illustrate the point, not necessarily be taken literally, though. Incidentally, I think I would meet your criteria for AEA (I have several books under my belt), but I don't think I would qualify by his standards.
A.That is the thing with lawyers. When they ask you about salary you have to wonder what they have in mind. It might be just how much money they can charge you. The sad thing is that the best lawyers handpick only the good cases with the best chances to keep their % of success high. In my opinion you need the best lawyer when your case is shaky. Salary above average is only one out of 7 categories. The median salary for a PhD with over is from 60-70 for recent graduates to 100- 150k for people with over 15 years in most sciences. So 300 is a big overkill. Most people I knew that got visas were below 35-40 doing post doc. Somehow I think that if somebody is making 6 figures he'd be under a lot of pressure to get it through family preferences
