Best Divorce AttorneyQ.I was divorced in December 2004 in California and as per the settlement, I was supposed to make an offer for my ex-wife's share of my 401k, after the court appointed accountant finished the calculations. I learnt that my wife's attorney misled the accountant about the date of separation. I have always maintained that the date of separation is the date I filed the divorce, wheras she insisted the date of separation to be much later than that. Anyways, to get the matter behind me, I made several offers to settle the matter and get it over with, and there was complete silence. I believe this may have been due to the fact that her immigration case was going on and aggreeing to an earlier date of separation would have proved that the marriage was over before she was eligible for immigration. Now 3 years later, suddenly, I found a notice of joinder (FL-370) listing my employer as the joining party. I would really like to get this matter behind me; At this stage, what is the best course of action for me. I cannot afford a lawyer. I have documents to show that I made all this written offers and got no reply, so at this stage, I am not even sure what she wants. I would also like to keep my employer out of this mess, if possible. After all, the employer cannot determine my date of separation. Any suggestions? A.You know, I have heard many times the comment "I cannot aford a lawyer". And I am reminded of the saying... "A person who represents himself has a fool for a client." As a preson who went through a very difficult divorce, I will tell you.... You cannot aford NOT to have lawyer! GET ONE! - FAST! Do what ever it takes. If you can establish the date of separation as the date YOU filed, and shove the divorce down her throat, then she may well be summarily deported from the country. This would, at the very least, impede her ability to act like a gold-digging leach on your wallet. I might point out that had you hired a lawyer, this likely would have been done already, and the entire thing WOULD be behind you. Since YOU filed, YOU control the process - MOVE IT ALONG. If, as you say, she is dragging her heals, it is to give her time to establish her citizenship so that she can then have plenty of time to come after you with guns blazing and the full weight of the kangroo kourts on her side. He who hesitates is lost, my man. This is WAR. You come at her from EVERY angle possible. When she gets hit from all sides, the she will be out-flanked, dispursed, and totally wondering what hit her as she waves goodbye to Amerika. You better start playing hardball, because if you give her enough time, I assure you SHE WILL play hardball (as you are starting to figure out!). And the courts are on HER side.
