Bankruptcy Lawyer PaQ.My husband filed joint taxes with a woman to whom he was not married in 1991. The balance that was left unpaid was around $15,000 - $20,000. My husband and this woman went their separate ways as my husband continued to make payments on this debt, had business transactions seized, etc. I married him and we had many financial troubles. We finally had to file Chapter 7 Bankruptcy 2 months ago. In our debts, we listed the1991 taxes that he filed with this woman. We also listed this woman, to say that he might owe her $20,000 so she couldn't hunt him down for this. She has just filed a form 8875 (innocent spouse relief) because the IRS is pursuing her also for this joint debt. If we'd had the money we would have paid, but unfortunately we could not help. Our bankruptcy is not yet complete. (It is a no asset case) I guess I'm wondering if by filing this 8875, the IRS can get into some loophole and come back and hold US responsible for the $20,000 even though we have filed bankruptcy for it. I spoke to a lady at the IRS who didn't think these debts ever went away.. Should I be consulting with a tax lawyer? My bankruptcy lawyer doesn't even seem to know what I'm talking about. A.If we're talking about the original assessment on a 1991 timely filed return, your husband's liability will be wiped out by the bankruptcy, absent fraud. OK, so technically he filed a false return, but let's not go there. If your concern is that IRS will come to your husband for the $20,000 phantom debt to pay off her liability, the bankruptcy should also wipe out any liability to her and, thus, to the IRS through levy on her assets. Talk to your bankruptcy lawyer. If your concern is that the IRS will recognize that the filed return was false and seek to assess new liability, unless they can show fraud, the statute for assessing a timely filed return has tolled. Yes, if they go that route, hire a good lawyer or accountant to represent you. If neither of those is the question you were asking, I'm at a loss, but I would suggest you voice your concerns to your bankruptcy lawyer as a starter.
