Q.it was sunday morning around 3 am and I was really tired driving back in the state of Indiana. drove around 113 mph. -no other traffic on the high way, 65 speed limit -one passenger sitting next to me -no alcoholic influence -cop didnt arrest me at the spot, let me go with the ticket -supposed to call the court for further information I need your help. Like what should I say in the court. I would like to reduce the reckless ticket to anything lesser. Preferably on my own without a lawyer, if possible.
A.If you want a reduced charge, you will probably need a lawyer to work the system for you. Nothing you have said gives the Indiana court much reason to consider leniency. Reckless (Code 9-21-8-52) is a Class B misdemeanor (up to $1,000 fine, up to 180 days in jail: Code 35-50-3-3), so getting it down to simple unlawful speed is a worthwhile objective and one well worth retaining a lawyer for. Indiana doesn't have a mandatory suspension for a single reckless-driving count, apparently (there has to have been an accident, Code 9-21-8-52; or three counts in a year, Code 9-30-4-6). But the state has discretion to suspend for "any reasonable ground" (Code 9-30-4-1).
