A.You can't sue your employer UNTIL you have exhausted the grievance process. Every attorney will ask right away if you have filed a grievance, gotten rejected, then filed an unfair labor practice. Once that is done, and you get rejected again, that's when you can get an attorney. The Fair Labor Standards Act created grievances to keep union members and employers involved in trying to resolve disputes themselves, so until you go that route you can't sue. You do not need to wait for your union rep to file the grievance; make him or her file it or demand the blank form; they are not hard to fill out. You will need to copy the section of your contract which has been violated and submit it to management. Make sure to date it and find out from your contract how many days they get to answer. If they don't answer in time, call your local National Labor Relations Board (NLRB) and ask to file an Unfair Labor Practice form. At some point management should get tired of this and transfer you.
