Q.I am from Atlanta. I met with a car accident in Louisiana. My car was not repaired properly by the body shop in Louisiana. I submitted to the body shop in Louisiana, letters from two insurance companies and three body shops in Atlanta that clearly stated that the body shop in Louisiana did not do the repair of my car properly. Since the body shop did not agree to pay my for the repairs of my car and rental car, I sued the body shop in a civil court in Louisiana. But the defendant attorney has moved the case to regular civil docket. What are my options now? Are the letters that I have collected from experts still valid in regular civil court? How do I fight this case and obtain justice?
A.You should consult with a LA attorney because LA's rules are different from most other states. However, I would think that EVIDENCE that could presented in one court could be presented in the other. You problem, at least under GA law, is that letters or estimates are not admissible without having the person who generated them in court to testify that they are true and correct.
